By accessing or using Framiq ("the Service," "Platform"), you ("User," "you") unconditionally agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms in their entirety, you must immediately cease all use of the Service. Using the Service constitutes full acceptance of these Terms, including all limitations of liability set forth herein.
Framiq provides an online platform enabling users to generate images and videos using third-party artificial intelligence models including, without limitation, Seedance, Kling, Veo, Runway, Flux, Ideogram, and others ("AI Models"). Framiq acts solely as an intermediary — we do not own, operate, or control the underlying AI Models. The availability, output quality, speed, and behavior of any AI Model is entirely outside Framiq's control.
The Service is in active development. Features may be added, modified, or removed at any time without prior notice.
You must create an account to access the Service. You represent and warrant that: (a) you are at least 18 years of age; (b) all information you provide is accurate and complete; (c) you have the legal capacity to enter into binding contracts in your jurisdiction; (d) your use of the Service does not violate any applicable law.
You are solely responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account. Framiq shall not be liable for any loss or damage arising from unauthorized access to your account resulting from your failure to safeguard your credentials.
Framiq reserves the right to suspend or permanently terminate any account at any time, with or without notice, for any reason including suspected violation of these Terms, fraudulent activity, or abuse of the credit system.
4.1 Credit System. The Service operates on a prepaid credit system. Credits are consumed upon initiating a generation request. The number of credits consumed per generation depends on the AI Model selected, the resolution, duration, and parameters chosen, as displayed before generation.
4.2 Credits Are Non-Refundable. ALL CREDITS PURCHASED ARE STRICTLY NON-REFUNDABLE. Credits are consumed at the moment a generation request is submitted to the underlying AI Model API, regardless of whether the output is satisfactory, usable, or whether the generation fails due to API errors, timeouts, rate limits, or third-party infrastructure issues. By purchasing credits, you expressly waive any right to a refund for consumed or unconsumed credits, to the fullest extent permitted by applicable law.
4.3 Credit Expiry. Top-up credits purchased as standalone packages do not expire for as long as your account remains in good standing. Subscription credits (credits included in a monthly plan) expire at the end of each monthly billing cycle and do not roll over. Framiq reserves the right to introduce credit expiry policies in the future with 30 days' prior notice.
4.4 Promotional Credits. Free credits awarded upon registration, via referral programs, or through promotional campaigns have no monetary value, are non-transferable, non-refundable, and may be revoked by Framiq at any time without prior notice. Promotional credits may carry additional restrictions communicated at the time of issuance.
4.5 Failed Generations. When a generation fails due to an error originating from a third-party AI Model provider's API, Framiq will make commercially reasonable efforts to refund the credits consumed for that failed generation. However, Framiq does not guarantee such refunds and shall not be liable for any damages arising from failed generations, including loss of business, revenue, or creative opportunity. Credit refunds for failures are issued at Framiq's sole discretion.
4.6 Pricing. All prices are displayed in EUR and are exclusive of applicable VAT or taxes. Framiq reserves the right to modify credit prices and subscription rates at any time. Changes take effect from the next billing cycle for existing subscribers, or immediately for new purchases.
4.7 Chargebacks. Initiating a chargeback or payment dispute without first contacting Framiq support constitutes a material breach of these Terms and may result in immediate account termination and the voiding of all remaining credits.
The AI Models accessible through Framiq are operated by independent third parties. Framiq does not warrant the availability, accuracy, quality, safety, or fitness for any particular purpose of any AI Model output. Framiq explicitly disclaims all liability for:
By using the Service, you acknowledge that Framiq is a reseller/aggregator of third-party AI capabilities and that Framiq has no control over model training data, output generation processes, or the policies of underlying model providers.
6.1 Ownership of Outputs. Subject to these Terms and the policies of the applicable AI Model provider, you retain ownership of content you generate on paid plans. On the free plan, generated content may include a visible watermark. Commercial use rights are subject to the policies of the underlying AI Model provider, which may vary and change over time.
6.2 License to Framiq. You grant Framiq a non-exclusive, worldwide, royalty-free license to store, cache, and display your generated content solely for the purpose of delivering the Service to you. We do not use your generated content to train AI models.
6.3 No Copyright Guarantee. Framiq makes no representation that AI-generated outputs are free from copyright claims by third parties. You use AI-generated content at your own risk. Framiq shall not be liable for any intellectual property disputes arising from your use of generated outputs.
6.4 Input Content. You warrant that any content you upload or input into the Service (prompts, images, reference material) does not infringe any third-party rights. You indemnify Framiq against all claims arising from your input content.
You expressly agree not to use the Service to generate, distribute, or promote:
Violation of this section results in immediate account termination, forfeiture of all credits without compensation, and may be reported to law enforcement authorities.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. FRAMIQ EXPRESSLY DISCLAIMS ALL WARRANTIES INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
FRAMIQ DOES NOT WARRANT THAT: (A) THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE; (B) ANY SPECIFIC AI MODEL WILL REMAIN AVAILABLE; (C) OUTPUTS WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS; (D) THE SERVICE WILL BE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FRAMIQ, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO: LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITIES, GOODWILL, OR ANTICIPATED SAVINGS — EVEN IF FRAMIQ HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL FRAMIQ'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO FRAMIQ IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE CLAIM; OR (B) €50.
THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY ON WHICH THE CLAIM IS BASED, INCLUDING CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER THEORY.
You agree to indemnify, defend, and hold harmless Framiq and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) content you generate or upload; (d) your violation of any third-party rights; or (e) your violation of any applicable law.
Framiq reserves the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice. Framiq shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service. In the event of a permanent shutdown of the Service, Framiq will make reasonable efforts to notify users 30 days in advance but does not guarantee the ability to do so.
Framiq reserves the right to modify these Terms at any time. We will notify users of material changes via email or a notice on the platform. Continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must cease using the Service.
These Terms are governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any dispute, controversy, or claim arising from or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts of Paris, France.
Before initiating any legal proceeding, you agree to first attempt to resolve disputes by contacting Framiq at legal@framiq.ai and allowing 30 days for resolution.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms shall otherwise remain in full force and effect.
